Your Private Chefs – Client Terms of Service

Effective as of January 2025

Thank you for choosing Your Private Chefs (YPC). By submitting payment and booking a private chef through YPC, you agree to the following terms and conditions:

1. Booking & Matchmaking Process

1.1 All client inquiries are subject to a $75 non-refundable service fee to begin the matchmaking process.
1.2 YPC will match you with a vetted private chef based on your event preferences, budget, dietary needs, and location.
1.3 Upon confirmation, you will receive the chef’s profile and direct communication access to finalize details.

2. Pricing & Payments

2.1 All pricing is discussed transparently and agreed upon directly between you and your assigned chef.
2.2 YPC does not collect the chef’s service fees. Payment for the culinary service is made directly to the chef.
2.3 The initial $75 matchmaking fee is retained by YPC and covers vetting, pairing, and concierge support.

3. Cancellation Policy – Client-Initiated

3.1 Cancellation Timeline & Fees

  • More than 7 days prior to the event: You may cancel with no penalty. The $75 matchmaking fee is non-refundable.

  • 7 days or fewer before the event: A 15% cancellation fee is assessed on the estimated total chef fee.

  • Within 72 hours of the event: YPC reserves the right to charge up to 50% of the chef’s quoted service fee, depending on prep and scheduling impact.

3.2 Ingredient Reimbursement

  • If the chef has already purchased ingredients, you are required to reimburse 100% of documented ingredient costs (receipts required) and pay an additional 10% handling fee for shopping and prep labor.

3.3 No Response / Ghosting

  • Failure to respond within 48 hours after receiving your chef match may result in cancellation.

  • In this case, the $75 fee and a $50 reservation hold penalty may apply.

3.4 Acts of Nature / Emergencies

  • In the case of verifiable emergencies (e.g., severe weather, medical emergencies), YPC will:

    • Attempt to reschedule the event within 30 days at no additional cost.

    • If rescheduling is not possible, a partial refund or credit will be offered at YPC’s discretion.

4. Chef Cancellations & Protections for Clients

4.1 If Your Chef Cancels

  • YPC will provide a replacement chef at no additional cost (within 48 hours), or offer a full refund— including the $75 fee—if no suitable match is found.

4.2 No-Show or Last-Minute Cancellation

  • If a chef fails to appear or cancels on the day of your event, you will receive a full refund and a credit toward a future booking; the chef will be removed from our platform pending review.

4.3 Substandard Experience

  • If a serious issue arises during service (e.g., unprofessional conduct, food safety concerns), YPC will investigate and, if verified, issue a partial refund or future booking credit.

4.4 Ingredient Handling

  • If ingredients were delivered but the chef cancels, you may keep the ingredients, or YPC will attempt to coordinate delivery through a replacement chef.

5. Dispute Resolution

  • If you have concerns regarding your booking, fees, or chef experience, contact YPC within 72 hours post-event.

  • YPC acts as a neutral third party to investigate and resolve disputes fairly. Final decisions are made at YPC’s discretion.

6. General Terms

  • All chefs listed with YPC are independent contractors, not employees of YPC.

  • YPC is not liable for direct interactions between clients and chefs beyond the scope of booking facilitation and service guidance.

  • By booking through YPC, you authorize us to manage all communication and dispute resolution in accordance with these terms.

7. Privacy & Data Protection

7.1 Privacy Policy

  • Our full Privacy Policy is available at https://yourprivatechefs.com/privacy.

  • You acknowledge and agree that YPC may use and share your personal data as described there, and that we will never sell or rent your phone number or personal information to third parties.

7.2 Communications

  • By providing your phone number, you consent to receive booking-related texts and calls. Standard message and data rates may apply. You may opt out at any time by replying STOP or contacting support.

8. Limitation of Liability

  • To the fullest extent permitted by law, YPC’s total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid to YPC for the service giving rise to the claim (i.e., the $75 matchmaking fee).

  • YPC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption.

9. Indemnification

  • You agree to indemnify, defend, and hold harmless YPC, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

    • Your breach of these Terms;

    • Your negligence or willful misconduct;

    • Any third-party claim related to services provided by a chef.

10. Force Majeure

  • Neither party shall be liable for delays or failures in performance due to causes beyond its reasonable control, including acts of God, government action, natural disasters, epidemics, or telecommunications failures.

11. Governing Law & Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict-of-law principles.

  • Any dispute arising hereunder shall be brought exclusively in the state or federal courts located in [Your County], [Your State].

12. Modification of Terms

  • YPC may amend these Terms at any time by posting the revised version on our website with a new “Effective” date. Your continued use of our services after such changes constitutes acceptance of the updated Terms.

13. Severability

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Waiver

  • No waiver by YPC of any breach or default shall be deemed a waiver of any subsequent breach or default.

15. Notices

  • All notices under these Terms shall be in writing and sent to:

16. Entire Agreement

  • These Terms (including the Privacy Policy) constitute the entire agreement between you and YPC regarding the subject matter herein and supersede all prior or contemporaneous communications.
